On 28 March 2019, the MoJ launched a consultation on extending fixed recoverable costs (FRC) in civil cases worth up to £100,000. The proposed extension follows Sir Rupert Jackson’s 2017 report, in which he argued that controlling litigation costs is “a vital part of promoting access to justice”.

The CLSB issued an impact survey to the 688 Costs Lawyers it regulates. Based on the outcome of that survey, the CLSB has today filed a response to the consultation identifying concerns raised by the profession and highlighting the potential impact on the regulatory objectives set out under the Legal Services Act 2007.
